Christmas Health and Safety Reminder
Please be advised that all employees planning to dash through the snow in a one-horse open sleigh, going over the fields and laughing all the way are required to undergo a Risk Assessment addressing the safety of open sleighs.
The assessment must also consider whether it is appropriate to use only one horse for such a venture, particularly where there are multiple passengers. Please note that permission must also be obtained in writing from landowners before their fields may be entered. To avoid offending those not participating in celebrations, we request that laughter is moderate only and not loud enough to be considered a noise nuisance.
Benches, stools and orthopaedic chairs are now available for collection by any shepherds planning or required to watch their flocks at night. While provision has also been made for remote monitoring of flocks by CCTV cameras from a centrally heated shepherd observation hut, all facility users are reminded that an emergency response plan must be submitted to account for known risks to the flocks. The angel of the Lord is additionally reminded that prior to shining his/her glory all around s/he must confirm that all shepherds are wearing appropriate Personal Protective Equipment to account for the harmful effects of UVA, UVB and the overwhelming effects of Glory
Following last year’s well publicised case, everyone is advised that legislation prohibits any comment with regard to the redness of any part of Mr. R. Reindeer. Further to this, exclusion of Mr. R Reindeer from reindeer games will be considered discriminatory and disciplinary action will be taken against those found guilty of this offence.
While it is acknowledged that gift-bearing is commonly practised in various parts of the world, particularly the Orient, everyone is reminded that the bearing of gifts is subject to Hospitality Guidelines and all gifts must be registered. This applies regardless of the individual, even royal personages. It is particularly noted that direct gifts of currency or gold are specifically precluded under provisions of the Foreign Corrupt Practices Act. Further, caution is advised regarding other common gifts, such as aromatic resins that may initiate allergic reactions.
Finally, for those involved in the recent case of the infant found tucked up in a manger without any crib for a bed, Children's Social Care have been advised and will be arriving shortly.

Following recent announcements, we are delighted to be able to provide you with further information about the changes to Paediatric First Aid training in early years settings and the upcoming launch of Millie's Mark.

Under new regulations, which are due to be included in the Early Years Foundation Stage (EYFS) guidance from the 1st September 2016, all newly qualified staff possessing a Level 2 or Level 3 Childcare qualification must also hold an Emergency Paediatric First Aid or a full Paediatric First Aid at Work Certificate in order to be included in the required staff to child ratios in an early years setting.

Update: The HSE advises that when carrying our a First Aid needs assessment, employers who identify a specific risk of life-threatening bleeding (eg: - those working in arboriculture, construction, glass work, agriculture or those who use dangerous machinery) should consider providing tourniquets and haemostatic dressings and ensure that their workplace First Aiders are fully trained in their uses.

Automated External Defibrillators (AED'S)

Update: The HSE bulletin asks that all Training Providers introduce training and assessment of AEDs into workplace First Aid Courses by the end of 2016. HSE does not expect every first aider to have an in-depth knowledge of AEDs, but learners will need to cover the correct placement of AED pads and following AED instructions.

Hospice sentenced after Legionella death

A hospice based in Sydenham has been sentenced after a patient died of Legionnaires’ disease and a worker suffered life changing effects as a result of contracting legionnaires disease.
In December 2012, an orderly worker contracted Legionnaires’ disease while carrying out her duties at the Hospice and spent 18 days in a coma before making a recovery.
After the hearing HSE inspector Matt Raine said: “The risks of legionella are well known in the healthcare industry. The Hospice had implemented some measures in an attempt to control legionella. However they failed to appoint a competent person to manage the risk of legionella in the Hospice’s hot and cold water system.
“The failures in the management of legionella led to conditions in hot and cold water system that favoured the proliferation of legionellae. It was entirely foreseeable that there would be risk of contracting legionnaires disease for patients and employees working at this hospice.”
The Hospice pleaded guilty to breaching Sections 3(1) and 2(1)of the Health and Safety at Work etc Act 1974, and was sentenced to a two year conditional discharge, and ordered to pay costs of £25,000.
Well they're off again Annie, Bill, Bob, Beryl & Brad on their travels, this time taking baby Bianca and her partner in crime Timmy with her. They will be stopping off at a few places this week, Rotherham being one of them, so give them a wave if you see them. First aid training – what will be compulsory?
As you’ve heard in the news recently, by 2016 all new nursery and pre-school staff will be legally required to undergo Paediatric First Aid Training. But what will this mean for early years providers? Does it affect everyone? And where can more information be found? 
The background
New proposals for first aid training in EYFS follow the tragic death of Millie Thompson, who died after choking at her nursery in October 2012. After losing their daughter in such a devastating way, Millie’s parents, Joanne and Dan Thompson, embarked on a huge awareness campaign for change – a change to the current rule that early years providers need to have just one paediatric first aider available on site.
A consultation by the Department for Education followed, reviewing in detail first aid training in early years settings and collecting thoughts and opinions from those involved in early years care to proposed amendments to the framework.
What will change?
New rules which result in a change to the EYFS have been announced by the government which affect paediatric first aid training in all early years’ settings. These changes come into force from the beginning of September 2016. The consultation showed overwhelming agreement among those who responded with the proposed changes.
There is also the introduction of a voluntary accreditation scheme called ‘Millie’s Mark’, which will be administrated by the National Day Nurseries Association.
What are the changes to the EYFS?
As of September 2016, all newly qualified level 2 or level 3 early years/childcare staff must have an emergency paediatric first aid or a full paediatric first aid (PFA) certificate, if they are to count towards staff:child ratios under the early years foundation stage. There will be a grace period of 3 months after starting work with a new employer in which to attain the first aid training certification.
The emergency first aid training course would be the equivalent of 1 day of training and would need to be refreshed every 3 years in order for the staff member to keep counting in the ratios.
There will be an exception included in the new EYFS on the grounds of equal opportunities that will allow disabled persons who are otherwise capable members of staff, but who may not be able to complete the training, to count towards staff:child ratios. It will be recommended that these staff members be required to attend PFA training to absorb and learn what they can. Those that do attend PFA training in these circumstances will receive a certificate of attendance.
According to the Department for Education, this change will add approximately 15,000 additional trained early year’s professionals to nurseries and pre-schools every year.
Key Points for EYFS Changes:
  • Applies from September 2016
  • Relevant for newly qualified level 2/3 childcare/EYFS staff
  • Comprises 1 day of training to attain either an Emergency Paediatric First Aid or full Paediatric First Aid certificate
  • Exceptions for disabled staff members where relevant
  • 3 months grace period after initial employment
  • Revised EYFS documentation to be published
  •  
Accreditation and ‘Millie’s Mark’ Gold Standard Certificates

In addition to the training requirements, there will be new certificate available for nurseries. This will be appropriately entitled ‘Millie’s Mark’, and will be given to nurseries that have been able to reach gold-standard levels.


The accreditation scheme will be administrated and awarded by the National Day Nursery Association, and the Gold Standard Millie’s Mark certificate will be awarded to those providers where all members of staff have completed PFA training. Is your Care Home up to standard???? 
A former Cheshire nursing home company has been fined £40,000 and must pay £19,283 in costs after pleading guilty to serious breaches of fire safety regulations.
Care home provider Smallwood Homes Ltd, the former owner of Thelwall Grange Nursing Home business in Warrington, Cheshire, pleaded guilty to eight serious breaches of the Regulatory Reform (Fire Safety) Order 2005 when the company appeared before Judge Roger Dutton at Chester Magistrates Court on 17 June 2016.
Smallwood Homes Ltd pleaded guilty to eight offences, which included: the lack of compartmentation; failure to have an adequate risk assessment in place, a suitable fire evacuation procedure, evacuation chairs for means of escape from the upper floors, and fire detection in the basement where the boiler was housed; as well as poor maintenance. Concerns were also raised about the adequacy of staff training.
Cheshire Fire and Rescue Service first served an enforcement notice on the property for fire safety breaches in February 2014.
Judge Dutton said: ‘You cannot be too careful, fire can very quickly take hold and have serious consequences including, ultimately, death.' He added that, while he accepted fully that the company had taken steps to help deal with issues, this wasn’t enough. He also took into account the fact that the company has since been sold and that Smallwood Homes Ltd no longer owns the Thelwall Grange Nursing Home business.
Simon Gibbins, head of protection at Cheshire Fire and Rescue Service commented: ‘Cheshire Fire and Rescue Service aims to help and support any business to operate safely. However, we will take action when companies choose not to treat fire safety as a legitimate business requirement. We urge all companies to take their fire safety obligations seriously to avoid prosecution.’
